TERMS AND CONDITIONS OF THE "EDITOR'S CHOICE"

1. Organizer
   CANON EUROPA NV, a limited liability company established under the laws of The Netherlands, having its registered address at Bovenkerkerweg 59-61, 1185 XB, Amstelveen, The Netherlands ("Canon") organizes the Editor's Choice on the CPN website.
2. The Editor's Choice
   The Editor's Choice is an editorial feature that appears on the Canon Professional Network ("CPN") website, where Canon offers users of the CPN website the opportunity to have their photographs displayed online.
   For the avoidance of doubt, the Editor's Choice is not a competition and Canon provides no guarantee that your submitted photograph (the "Photograph") will be published or shown on the CPN website. No purchase or entry fee is required to participate in the Editor's Choice. By submitting a Photograph you agree to be bound by these terms and conditions (the "Terms and Conditions") in addition to the terms and conditions of use of the CPN website, available at http://cpn.canon-europe.com/content/terms_and_conditions.do All participants must be at least of 18 years of age at the time of submitting the Photograph and agree to be bound by these terms and conditions. Each user may only upload a Photograph in JPEG format, with a maximum file size of 7.5 MB and a minimum dimension of 800x600 pixels with a resolution of 72ppi, which has been taken with a Canon camera. Any User submitting a Photograph displaying an URL, email address or similar identifiable information will be disqualified as well as Photographs which are clearly offensive based on race, gender, religion or similar.
   You agree that any photograph you submit can be displayed anonymously on the CPN website prior to editorial judging or public vote. All submitted Photographs will be screened and judged by an independent third party selected by Canon (the "Editor") and may be put forward for a public vote. Selection and judging of Photographs are done by the Editor and/or the public and not Canon.
   If your Photograph is selected by the Editor or by any public vote, you agree that Canon can use and display it on the CPN website in accordance with the rights granted in these Terms and Conditions. Canon will not make any other use of your Photograph without your explicit approval.
3. Licenses
   By submitting a Photograph you expressly agree that you automatically grant to Canon the non-exclusive, free of charge and royalty-free right to use and display this Photograph on the CPN website, at anytime and for an indefinite period of time (including in the archive of the CPN website) for the purpose of inspiring and informing professionals and advanced enthusiasts who use and enjoy Canon's photography products. You also agree the use of this Photograph in other Canon media, such as websites and printed materials, but only to promote CPN Editor’s Choice.
   Prior to judging and selection by the Editor and prior to any public vote, your Photograph may be displayed on the CPN site with other entries anonymously so as to ensure the impartiality of the Editor’s selection and any public vote. Thereafter, Canon and its affiliates shall always identify you as the author of the Photograph.
   In the event that Canon and or its affiliates wish to make further use of your Photograph, Canon and or its affiliates shall contact you to arrange for your consent.
   In the event that you want to end the right for Canon to display your Photograph as specified above, you shall notify Canon in writing at cps@canon-europe.com and Canon undertakes to remove your Photograph where possible within a reasonable time upon receipt of your notification in English.
   Except as expressly provided under these Terms and Conditions, no license or right, express or implied is hereby conveyed or granted by you to Canon and its affiliates or by Canon and its affiliates to you in relation to any intellectual property of you or Canon and its affiliates.
4. Warranties
   By submitting a Photograph, you promise to Canon that:
   1. You are the author of the Photograph and you have the full and entire proprietary rights in the Photograph, and you have the full and unlimited right to exploit those rights;
   2. The Photograph and any element appearing in the Photograph and their use by Canon, its affiliates and/or sub-licensees within the scope of the license granted under these Terms and Conditions do not infringe or breach the rights of any third-party, including but not limited to intellectual property rights, rights of privacy, confidentiality and image rights;
   3. In the case where a person or person's image appears in the Photograph, you have obtained an express permission from this person(s), for Canon and its affiliates to use his / her image(s) within the scope of the license granted under these Terms and Conditions.
5. Disclaimers
   Canon reserves the right to cancel the Editor's Choice at any time and/or to remove your Photograph from the CPN website at anytime (in the case it has been selected by the Editor).
6. Governing Law
   The laws of The Netherlands will apply to these Terms and Conditions and any dispute in connection with the Editor's Choice will be submitted to the exclusive jurisdiction of the courts of Amsterdam, The Netherlands.
7. Privacy Policy
   Canon is committed to protecting your privacy. Any (personal) data supplied by you will be used by Canon solely for the purpose of performance of the Editor's Choice. Any (personal) data provided during the registration and submission of the Photograph is held in a secure environment. You have the right to access, correct, update, or delete your (personal) data.
